Accepting These Terms
By downloading, accessing, or using Berry, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use Berry.
What Berry Provides
Berry provides food-product information, personalized educational explanations, comparison tools, diary features, and AI-generated guidance. Features and availability may change as we improve the service.
Not Medical Advice
Berry is for general informational and educational purposes. It is not a medical device and does not provide medical diagnosis, treatment, or professional dietary advice. Product data, AI responses, and personalized explanations may be incomplete or incorrect. Always verify labels, ingredients, allergens, and safety information directly on the product, and consult a qualified professional about medical or dietary decisions. Do not use Berry for emergencies.
Your Account
You are responsible for the accuracy of information you provide, protecting access to your account, and activity under your account. You must notify us promptly if you suspect unauthorized access. You may not impersonate another person or use Berry if applicable law prohibits you from doing so.
Acceptable Use
You may not:
- Use Berry unlawfully or to harm, threaten, or deceive others.
- Interfere with the service, probe its security, introduce malicious code, or bypass technical limits.
- Scrape, reverse engineer, copy, resell, or commercially exploit Berry except where applicable law expressly permits it.
- Submit content that infringes rights, violates privacy, or is illegal.
- Misrepresent AI-generated output as professional advice.
Your Content
You retain ownership of content you submit. You grant us a worldwide, non-exclusive license to host, process, reproduce, and use that content only as needed to operate, secure, and improve Berry and provide features you request. You confirm that you have the rights needed to submit it.
Subscriptions and Purchases
Some features may require a paid subscription. Prices and billing terms are shown before purchase. Purchases made through Apple are billed and managed by your Apple ID and are subject to Apple’s payment terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple ID subscription settings. Except where required by law, payments are non-refundable; Apple handles eligible refund requests for App Store purchases.
Third-Party Services and Product Information
Berry relies on third-party services and food information from product labels, manufacturers, retailers, public datasets, and other sources. We do not control those sources and do not guarantee that product availability, ingredients, nutrition, allergen details, prices, or other information are complete, current, or error-free.
Ownership
Berry, including its software, design, branding, and original content, is owned by Senzu Labs LLC and its licensors. These terms give you a limited, personal, non-transferable, revocable right to use Berry. They do not transfer ownership to you.
Suspension and Termination
You may stop using Berry or request account deletion at any time. We may suspend or terminate access when reasonably necessary to protect users, comply with law, address a breach of these terms, or protect the service. Provisions that logically continue after termination will survive.
Disclaimers and Limitation of Liability
To the fullest extent permitted by law, Berry is provided “as is” and “as available” without warranties of any kind. Senzu Labs LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill, arising from your use of Berry. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Changes
We may update Berry and these terms. If changes are material, we will provide notice as required. Continuing to use Berry after updated terms take effect means you accept them.
